Principal Certifier Appointments

The Principal Certifier is appointed by the owner to oversee a building project from commencement to completion. The role is to act independently in the public interest, confirming that the work proceeds in accordance with the approval and that mandatory inspections are carried out.

Overview

Under the post-2020 framework, the term Principal Certifier replaced Principal Certifying Authority. The Principal Certifier is engaged by the person having the benefit of the development consent, the owner, and not by the builder. This independence is central to the role.

Before work begins, a Notice of Commencement is lodged and the Principal Certifier appointment is recorded on the NSW Planning Portal. During construction, the critical stage inspections set by the Environmental Planning and Assessment (Development Certification and Fire Safety) Regulation 2021 are carried out at the right points by the Principal Certifier, or by another registered certifier as agreed.

At completion, the Principal Certifier assesses the project for the Occupation Certificate. Appointing the certifier early means inspection points are scheduled in advance and documentation is assembled as the project progresses, rather than scrambled at the end.

Common issues and delays

Late appointment

Engaging a Principal Certifier after work has started can leave required inspections un-witnessed and create compliance gaps.

Un-witnessed inspections

A critical-stage inspection that is missed cannot simply be repeated later; it may require a remediation pathway.

Commencement before lodgement

Beginning work before the Notice of Commencement and appointment are recorded is a regulatory breach.

Assuming the builder appoints

The owner appoints the certifier. Misunderstanding this can delay the start of the project.
