Swimming Pools
A swimming pool is regulated development. Most new pools can be approved as complying development where the lot is eligible and the design meets the code, and the barrier must comply before the pool is filled and used.
Overview
A new pool, and the works around it, are usually assessed against the Codes SEPP. Where the lot is eligible and the proposal meets each standard (siting, setbacks from boundaries and dwellings, and distance from easements), a Complying Development Certificate combines planning and construction approval in one step. Otherwise the pool proceeds by development application.
Separately, the child-resistant barrier must comply with the Swimming Pools Act 1992 and AS 1926.1, covering barrier height, gates and latching, non-climbable zones and resuscitation signage, and the pool must be listed on the NSW Swimming Pool Register. We assess the pool through to its Occupation Certificate, and certify the barrier’s compliance.

Eligibility
We confirm whether the pool can use the CDC pathway, or requires a development application.

Approval
A CDC is issued for the pool and its surrounds, or a CC follows the development consent.

Construction & inspections
Critical stage inspections proceed, including the pool shell and the safety barrier.

Compliance & completion
The barrier is certified, the pool is registered, and the Occupation Certificate is issued.

Signage & registration

Existing pools
Barrier compliance can be certified for an existing pool, commonly needed before a sale or lease.
